In a country like ours – where the same band of protesters who have been leading the mobs in Kasur are vehemently against any attempts to either include knowledge about sexual abuse within textbooks or educate children about this issue – the problem is, of course, aggravated. It is aided also by hypocrisy and the refusal to discuss how commonplace the problem is in a repressed society where expression has been systematically removed by censoring the arts, clamping down on dance, theatre and other forms of entertainment and replacing these elements with a misguided sense of reality....

 

“There are times when even reaching the workplace seems like a project in itself,” she said. She recalled how difficult it had been in the summer of 2010, when she had been doing her PhD while the state witnessed a large uprising. Her experiments would take longer to finish and reaching home on time was difficult. “Being a woman adds to this misery. To work in these circumstances as we are facing here – it’s been a challenge to keep my lab functional.”...

A basic principle of Islamic Shariah states that when a commandment is revealed, even if the masculine form of a word is used, the female gender is also included in this commandment. If this principle is rejected then the basic pillars of Islam such as prayer, fasting and pilgrimage will become null and void for women. So, though God Almighty and the Holy Prophet (blessings and peace be upon him) use the masculine form of sentence to describe most of the commandments, women are also bound to act and follow those rules and regulations....

In its current form, the Bill is designed to keep alive the triple Talaq issue, as I have argued, for electoral and political purposes. There are also other concerns that Muslim men can be harassed by cops, especially when communal leaders win in a certain region. Under this Bill, the instant triple Talaq is cognisable offence, which means – as noted by the writer Rana Safvi – a policeman does not need a warrant to arrest, nor does the complaint have to be filed by the Muslim woman. Any person can file a complaint against a Muslim husband leading to his arrest. This Bill is arbitrary in nature.....

The practice of triple Talaq was a clear violation of the Holy Quran. Islam has stressed equality in rights between men and women; divorce is permissible, but only after consideration and counselling, with conditions that include maintenance for the wife. Surah 2 Verse 228 of the Quran is categorical: “And women shall have rights similar to the rights against them, according to what is equitable”. Verse 241 is equally explicit: “For divorced women maintenance should be provided on a reasonable scale. This is a duty on the righteous.”....

Triple Talaq Bill Could Be a Stepping Stone Towards a More Comprehensive Codification of Gender-Just Muslim Family Law Reform in India

The reason why activists who work with Muslim women on the ground and with scores of survivors of "triple Talaq" support the bill is because they see the destitution that this practice has caused. They do not see merit in losing an opportunity for reform because the party in power is right-wing. This bill could be a stepping stone towards a more comprehensive codification of gender-just Muslim family law reform in India.....

The Quran teaches Muslims to honour contracts and obligations, it says what means: “O you who have believed, fulfil (your) obligations.” [Quran 5:1] It is absolutely Haraam (unlawful) for the Muslim to lie, cheat or otherwise be dishonest in carrying out any job big or small. For those women who choose to work, there may be challenges of today’s work environment, but for any Muslim woman, meeting these challenges is not impossible....
