    Muhammad Yunus, New Age Islam

    A frequent contributor to NewAgeIslam.com, Muhammad Yunus, is an Engineering graduate from IIT Kharagpur (1966) and retired as technical director, from a multinational company (1997) and later from a large industrial complex (2010).     While the list of brutal rulings can be extended, they do not constitute ‘Islamic religious ideology (Sharia), as they derive from the Sharia Law of Islam which is distinctly different from the Sharia of Islam. There is a subtle but irrefutable difference as explained below:

    The Qur’an represents the divine Sharia of Islam (5:48) which is preserved verbatim as revealed over fourteen centuries ago, and is not influenced by the opinion of scholars, politicians, intellectuals, philosophers or any human agency. It uses the words Shira (technically Shir’ah) and Sharia (tech. Shar’iah) synonymously with the generic notion of a system or principles of law (5:48, 45:18). It expounds fundamental universal notions for just and harmonious governance of human society. These include, among others, justice, liberty, equity, good deeds, good neighbourly and inter-faith relations, sharing of wealth with the poor, eradication of slavery, deliverance of women from various entrenched taboos, empowerment of women use of intellect (Aql) and rational logic (Fiqha) , striving for excellence – to cite some major examples….

    To wrap up this essay and put a seal of peace and pluralism on the Prophet’s mission we quote below the following verses that make it amply clear that the eventual goal was peace, moral uprightness (taqwa) and justice and not war, injustice and ‘Sword’: 

    “You who believe, be upright before God as witnesses to justice), and let not the hatred of any people prompt you to detract from justice. Deal justly: this is nearest to heedfulness (taqwa); and heed God. Surely God is Informed of what you do” (5:8).

    “... And let not the hatred of a people who (once) obstructed you from (entering the) Sacred House, lead you to be hostile. Therefore, help each other to virtue and uprightness (taqwa), and do not collaborate with each other in sin and enmity. Heed God, and (remember,) God is severe in punishment” (5:2).

    “It may be that God will bring about love between you and those of them you (now) regard as your enemies. (Remember,) God is Able (to do anything) and God is Most Forgiving and Merciful (60:7). God does not forbid you to be virtuous and just to those who did not fight you over religion, nor drove you from your homelands. Indeed, God loves the just (60:8). God only forbids you to befriend those who fought against you over religion, and expelled you from your homelands, and backed (others) in your expulsion; and whoever befriends them – it is they who are unjust” (60:9).

    The Qur’anic verses relating to all the major expeditions as captured in this work from Qur’anic allusions were specific to given contexts, and since the contexts cannot be recreated as much as the Prophet and his companions cannot be brought back to life, they are not of any direct relevance this day – and this must be true for all so-called ‘fighting verses’ of the Qur’an.     Human knowledge remains in flux. What is held true today may be proved false tomorrow except in strictly scientific domains that represent the ultimate truths of God (the earth is round; the desert has little rainfall, water flows down the slope for example).     The Classical approach to understanding the message of the Qur’an that dates back to around the third century of Islam is through reading the Tafsir corpus which are drawn on the secondary sources of Islam, namely, the Hadith, the Sira, including the opinion (Rai) of past scholars, and the consensus of scholars (Ijma). The Mufassir (exegete) attempts to explain each verse of the Qur’an in light of these secondary sources or based on his own knowledge, doctrine, speculations and choice of source material. This renders Qur’anic exegesis a highly porous domain as the same verse can be interpreted differently by different Mufassirin engaging a different Hadith, Sira report, and opinion, or consensus of scholars (Rai, Ijma);and holding differing doctrinal orientation and worldview.

    This in turn leads to enormous divergence and even contradiction in understanding what the Qur’an has to say on any given theme – the dress code for women, inter-faith relations, business practices, lawfulness of various bounties of God like song and music, governance of society, educational system and choice of profession and business pursuit, marriage, divorce laws….

    If a broad based live material proof of the evil and anti-Islamic character of the ISIS were needed, it is in the exodus of the predominantly Muslim refugees from the lands ISIS wrenched away by shear brutality. The plight of these refugees is truly indescribable: they fled their homes in panic leaving all their belongings behind with no provisions, no security, no transport, no food or water, no destination except where their feet or vehicles took them and risking untold miseries that lay in their paths. While none may dare to openly call the ISIS as antithesis of Islam as the Muslim mind is overwhelmed by its (ISIS’s) cloak of religiosity, if Caliph Umar, the son-in-law and the fourth among the Rightly Guided Caliphs were to come alive this day, he would have surely declared the leaders and activists of ISIS and other terror outfits operating in the name of Islam (Boko Haram, al-Shibab, Taliban and al-Qaida) as renegade-apostates of Islam (Kharijite) who lost any claim to the faith of Islam and deserved to be killed without any trial [1]. But in the absence of Caliph Ali, who is going to bell the cat?....

    The truth is, the institution of triple talaq (instant divorce) deprives a married Muslim woman of her Qur’an rights of counseling, arbitration and negotiation with her husband prior to the termination of her conjugal rights that is binding on a man as her awliya (9:71) and qawwam (4:34). Furthermore, it gives a Muslim husband infinite power to blackmail his wife into doing anything, however immoral, or to abuse her in any way he wishes, or curtailing all her civil rights, and even forcing her to break her parental filial ties by dangling the dagger of triple talaq over her head. It is a far greater weapon of extortion and black-mail than a loaded revolver that can kill a woman’s body once and for all rather than turn her into a living dead – killing her soul leaving the body alive to bear the agony of moral death, having been reduced to virtually a slave of her husband who could shout at her at whim, beat her up, torture her and throw her out of his life by uttering once terse sentence. It is by far the most heinous legalized extortion of the defenseless married Muslim women in India that forces this Muslim writer to exercise utmost restraint in castigating its advocates lest he may be charged of using unscholarly diction and reduce this most serious essay into polemical narrative.

    ... with the emergence of multi-religious / secular states and separation of religion and politics and common taxation for all confessional groups in most countries of the world, Jizyah has lost its historical relevance. Today, the religious minorities in a predominantly Muslim country is subject to the national drafting (whether by way of conscription or voluntary enrolment) and are thus intrinsically exempt from any additional taxation by way of Jizyah, as much as Muslim minorities do not bear any additional taxation in a predominantly non-Muslim/ secular country.

    To wind up this essay, the author would like to quote the following verses from the Qur’an that capture the essence of its message on inter-faith relations:

    “O People! We have created you as male and female, and made you into races and communities* for you to get to know each other. The noblest among you near God are those of you who are the most heedful (Atqakum). Indeed God is All-Knowing and Informed” (49:13).

    “It may be that God will bring about love between you and those of them you (now) regard as your enemies. (Remember,) God is Able (to do anything) and God is Most Forgiving and Merciful (60:7). God does not forbid you to be virtuous and just to those who did not fight you over religion, nor drove you from your homelands. Indeed, God loves the just (60:8). God only forbids you to befriend those who fought against you over religion, and expelled you from your homelands, and backed (others) in your expulsion; and whoever befriends them – it is they who are unjust” (60:9)....

But unless the 99.99% common Muslim youths are counter-indoctrinated against terrorism and fully convinced of the disconnect between the pristine message of Islam and its distorted projected or claimed message, the impressionable youth may succumb to radicalization – especially the students of Classical religious schools called madrasas, where Islamic secondary sources and Sharia law are often taught as core subjects…..

    Sixteen years after 9/11, the issue of Jihadi terrorism has become even more complex and widespread.

    First, though Jihadism is a violent offshoot of Wahhabism and Salafism, the international community has allowed the fountainhead of Wahhabi/Salafi ideology to continue to spend tens of billions of dollars to Wahhabise the world Muslim community.

    Second, we recently saw with horror, but without any protest from the international community, the sight of a UN-designated terrorist, with a ten-million-dollar bounty on his head, launch a political party and nominate another US-designated terrorist to contest democratic elections in Pakistan. Apparently, some countries can ignore UN directives with impunity.

    Third, the Muslim community has failed to grasp that Jihadism spread so rapidly around the world because at its core it is not very different from the theology of consensus that informs the religious beliefs and practices of all Muslim sects. That is why Jihadis are not impressed when we Muslims either proclaim that Islam is a religion of peace and pluralism or when we try to wash our hands off Jihadism by claiming that it has nothing to do with Islam. If we Muslims want to live as honourable citizens in the 21st century’s globalised world, we must rethink our consensus theology in all its dimensions and make revolutionary changes to bring it in line with the needs of present times....
