    The Correct Understanding of the So Called ‘Sword’ Verses of Surah Taubah

    The discussion on the verses of Surah Taubah clearly establish that the above two principles, were never violated by the Prophet in his battles against the enemy, and are fundamental principles of Islam. The peaceful Mushrikin had the choice of retaining their religion and paying Jizya and the others had a choice to migrate and retain their religion.

    Those who had fought against the Muslims, in violation of their treaty, were deserving of the death punishment, according to the rules of that society. Even these people were given the opportunity to migrate during the amnesty period, and save themselves. The judgment was not only in accordance with the secular law of that society, but more humane and merciful. Calling these the “sword verses” is therefore a complete misrepresentation of both the intent and the outcomes. The people to whom the key words Mushrikin, Kafirin, La Yalamun and La Yuminun apply, and therefore their meaning, is explained with the help of the verses themselves…..

Of course, war-time verses had come in a certain context which no longer exists and so these instructions can no longer apply to us. The first task before us is to come out of denial, accept that our theology and jurisprudence have been corrupted and then start thinking of changing our mindset, so that we can live as peaceful citizens of this inter-connected twenty-first century world....

    Arguing that there is no religious basis for the continued existence of triple Talaq amongst Muslims, Sultan Shahin stated that it was only during a specific context that the practice arose and then also, the practice was looked down upon as an exception rather than a rule. Thus the practice of triple had no basis in the Quran as it was patently discriminatory towards women, something which goes against the basic teachings of the Quran. Moreover, this issue is not just religious, but also one of human rights. India being a signatory to the UN charter of Human Rights cannot go against such a law and practice which militates against the concept of justice for women. Sultan Shahin also mentioned that Imam Abu Hanifa, whose followers form the majority of South Asian Muslims and are known as Hanafis, had termed the practice of triple Talaq as Haram and yet Muslims of this region are following it as if it is the practice ordained by Allah. ....
