Islamic State’s Genocidal Campaign Against Yazidis Will Prevail Until The Full Scope Of Islamic State Crimes Are Unearthed And Justice Is Delivered

Five years ago, Islamic State fighters invaded my ancestral homeland of Sinjar, Iraq, and waged a systematic ethnic-cleansing campaign against the Yazidi community. Their campaign included mass executions, forced religious conversions and widespread sexual violence. These attacks resulted in the massacre of Yazidi men, women and children; the enslavement of nearly 7,000 Yazidis; and displacement of more than 400,000 Yazidis to camps in northern Iraq.

But that was not the end of our suffering. As Sheri P. Rosenberg observed in a 2012 article, genocide is a process, not an event. The continued suffering, fear and uncertainty in the Yazidi community show that the genocide process is ongoing. About 350,000 Yazidis remain trapped in camps in northern Iraq. Yazidis in these camps live in weather-worn tents without adequate access to food, water, electricity, education or opportunities to work. They also lack basic health care, including psychological support to aid in trauma recovery.

An estimated 3,000 abducted Yazidi women and children are still missing, with fears that some might have been sold to al-Qaeda affiliates — women and girls to be sex slaves, boys to be trained as fighters. Others may have been forcibly relocated to cities in other countries or have become collateral damage in military offensives in the region. Though thousands of Yazidis have sought asylum in Europe and elsewhere, foreign governments are approving fewer and fewer asylum claims, making it more difficult for Yazidis to seek safety.

But the Yazidi people are not without hope. We want justice, we want to rebuild, and we want to go home — but we cannot do so without support. As we approach the fifth anniversary of the Yazidi genocide on Aug. 3, I call on the international community to undertake concrete actions to support the repatriation of Yazidis.

In my recent speech at the State Department’s Ministerial to Advance Religious Freedom, I outlined the necessary steps for the successful return and rehabilitation of the Yazidi community. These include resolving Sinjar’s local governance issues, investing in long-term sustainable development initiatives, recruiting Yazidis into Iraq’s official security forces and prosecuting the Islamic State for war crimes. These steps are not only crucial to helping the Yazidis recover from the genocide but can also promote the rebuilding of trust among the different communities in Iraq, ultimately supporting the process of peace and reconciliation in the region.

While we estimate that 80,000 Yazidis have returned to Sinjar, local conflicts complicate survival. The Islamic State’s collapse created a power vacuum, opening the door for competing groups that occupy some portion of Sinjar but do not have complete control. The situation is further complicated because of disagreements between Baghdad and Irbil over governance and security in Sinjar. The Yazidi people cannot return to their homeland when security risks remain high. They must be given a voice, both in governance and over security decisions.

As factions vie for strategic dominance, our community also suffers from a lack of infrastructure. Investment in sustainable development initiatives in the Yazidi homeland is vital. Funds are needed for rebuilding homes and public facilities, such as hospitals and schools. According to the United Nations Development Program’s Funding Facility for Stabilization 2018 Q3 Report, more than 90 percent of recovery projects in the region are underfunded, and the funding has decreased by 41 percent since 2017. The UNDP identifies this gap as the most significant challenge to stabilizing the area, and international support is crucial for meeting these needs.

Finally, the Yazidi people deserve justice for the atrocities committed against them. This year, Sweden called for support from European allies to establish an international Iraq-based war crimes tribunal, modelled after the International Criminal Tribunals in Rwanda and the former Yugoslavia, to prosecute Islamic State fighters. The Syrian Accountability Project’s Report on the Yazidi Genocide recommends an international effort to preserve the physical evidence of Islamic State crimes, including archival documentation of Yazidi survivors and their stories and protection of forensic evidence such as mass graves. Moreover, the international community can help the Iraqi government locate the still missing Yazidis or record their fate. Until the full scope of Islamic State crimes are unearthed and justice is delivered, our people will continue to suffer.

The international community fought to defeat the Islamic State — but the job is not done. Abandoning the Yazidis to a war-torn land and uncertain future allows the seeds of further violence to take root. If the international community refuses to exchange platitudes for swift action, the Islamic State’s genocidal campaign against Yazidis will prevail.

  • Contemporary Islamic State is entirely different from historical Islamic State that Muslim extremists pursue. First, the hadith supports Islamic State in the past permits Muslims to trade with pagans and yet modern Islamic State has the eagerness to wipe them out due to they do not want to trade or deal with them. The following is the extract: Narrated `Abdur-Rahman bin Abu Bakr: We were with the Prophet (ﷺ) when a tall pagan with long matted unkempt hair came driving his sheep. The Prophet (ﷺ) asked him, "Are those sheep for sale or for gifts?" The pagan replied, "They are for sale." The Prophet (ﷺ) bought one sheep from him. حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا مُعْتَمِرُ بْنُ سُلَيْمَانَ، عَنْ أَبِيهِ، عَنْ أَبِي عُثْمَانَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرٍ ـ رضى الله عنهما ـ قَالَ كُنَّا مَعَ النَّبِيِّ صلى الله عليه وسلم ثُمَّ جَاءَ رَجُلٌ مُشْرِكٌ مُشْعَانٌّ طَوِيلٌ بِغَنَمٍ يَسُوقُهَا فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ بَيْعًا أَمْ عَطِيَّةً أَوْ قَالَ أَمْ هِبَةً ‏"‏‏.‏ قَالَ لاَ بَلْ بَيْعٌ‏.‏ فَاشْتَرَى مِنْهُ شَاةً‏.‏ The extract above is from Sahih al-Bukhari 2216, in-book reference: book 34, hadith 163, USC-MSA web (English) reference: vol 3, book 34, hadith 419. Second, people in historical Islamic State prevent pagans to perform Hajj due to they were not Muslims and yet contemporary Islamic State forces them to join Islam to perform Hajj or else they persecute them. Narrated Abu Huraira: Abu Bakr, on the day of Nahr (i.e. slaughtering of animals for sacrifice), sent me in the company of others to make this announcement: "After this year, no pagan will be allowed to perform the Hajj, and none will be allowed to perform the Tawaf of the Ka`ba undressed." And the day of Al-Hajj-ul-Akbar is the day of Nahr, and it called Al-Akbar because the people call the `Umra Al-Hajj-ul-Asghar (i.e. the minor Hajj). Abu Bakr threw back the pagans' covenant that year, and therefore, no pagan performed the Hajj in the year of Hajj-ul-Wada` of the Prophets. حَدَّثَنَا أَبُو الْيَمَانِ، أَخْبَرَنَا شُعَيْبٌ، عَنِ الزُّهْرِيِّ، أَخْبَرَنَا حُمَيْدُ بْنُ عَبْدِ الرَّحْمَنِ، أَنَّ أَبَا هُرَيْرَةَ، قَالَ بَعَثَنِي أَبُو بَكْرٍ ـ رضى الله عنه ـ فِيمَنْ يُؤَذِّنُ يَوْمَ النَّحْرِ بِمِنًى لاَ يَحُجُّ بَعْدَ الْعَامِ مُشْرِكٌ، وَلاَ يَطُوفُ بِالْبَيْتِ عُرْيَانٌ‏.‏ وَيَوْمُ الْحَجِّ الأَكْبَرِ يَوْمُ النَّحْرِ، وَإِنَّمَا قِيلَ الأَكْبَرُ مِنْ أَجْلِ قَوْلِ النَّاسِ الْحَجُّ الأَصْغَرُ‏.‏ فَنَبَذَ أَبُو بَكْرٍ إِلَى النَّاسِ فِي ذَلِكَ الْعَامِ، فَلَمْ يَحُجَّ عَامَ حَجَّةِ الْوَدَاعِ الَّذِي حَجَّ فِيهِ النَّبِيُّ صلى الله عليه وسلم مُشْرِكٌ‏.‏ The above extract is from Sahih Bukhari 3177, book 58, hadith 19, vol 4, book 53, hadith 402. The phrase, no pagan will be allowed to perform the Hajj, as mentioned above implies Muslims in the past only permit Muslims to enter into Hajj to worship Allah and yet contemporary Islamic State forces pagans, whether they believe or not believe in Allah is not important, and force them to join Muslims worshipping. As long as they are willing to join, they will not persecute them. Yet historical Islamic State was different only those who were Muslims could be allowed to perform the Hajj. Third, Hadith permits Muslims to associate pagans without killing them and yet contemporary Islamic State only wish to wipe out all pagans and to disallow any pagans to exist in their established region. The following is the extract: Narrated Ibn `Abbas: Allah's Messenger (ﷺ) (p.b.u.h) was asked about the children of (Mushrikeen) pagans. The Prophet (ﷺ) replied, "Since Allah created them, He knows what sort of deeds they would have done." حَدَّثَنَا حِبَّانُ، أَخْبَرَنَا عَبْدُ اللَّهِ، أَخْبَرَنَا شُعْبَةُ، عَنْ أَبِي بِشْرٍ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ ـ رضى الله عنهم ـ قَالَ سُئِلَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ أَوْلاَدِ الْمُشْرِكِينَ فَقَالَ ‏ "‏ اللَّهُ إِذْ خَلَقَهُمْ أَعْلَمُ بِمَا كَانُوا عَامِلِينَ ‏"‏‏.‏ The extract above is from Sahih al-Bukhari 1383, book 23, hadith 136; vol. 2, book 23, hadith 465. The phrase, Allah's Messenger (p.b.u.h)..asked about the children of (Mushrikeen) pagan, as mentioned here implies Muslims in historical Islamic State allow them to associate with pagans. Fourth, Muslims in historical Islamic State employed pagans to work for them and even paid them salaries and yet people in contemporary Islamic State wish all pagans to be wiped out from their established region. The following is the extract: Narrated Aisha: (the wife of the Prophet) Allah's Messenger (ﷺ) and Abu Bakr hired a man from the tribe of Bani-Ad-Dil as an expert guide who was a pagan (follower of the religion of the pagans of Quraish). The Prophet (ﷺ) and Abu Bakr gave him their two riding camels and took a promise from him to bring their riding camels in the morning of the third day to the Cave of Thaur. حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، حَدَّثَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، قَالَ ابْنُ شِهَابٍ فَأَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، أَنَّ عَائِشَةَ ـ رضى الله عنها ـ زَوْجَ النَّبِيِّ صلى الله عليه وسلم قَالَتْ وَاسْتَأْجَرَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَأَبُو بَكْرٍ رَجُلاً مِنْ بَنِي الدِّيلِ، هَادِيًا خِرِّيتًا وَهْوَ عَلَى دِينِ كُفَّارِ قُرَيْشٍ، فَدَفَعَا إِلَيْهِ رَاحِلَتَيْهِمَا، وَوَاعَدَاهُ غَارَ ثَوْرٍ بَعْدَ ثَلاَثِ لَيَالٍ بِرَاحِلَتَيْهِمَا صُبْحَ ثَلاَثٍ‏.‏ The extract above is from Sahih al-Bukhari 2264, book 37, hadith 5, vol 3, book 36, hadith 465. From the above extracts, it is obvious that modern Islamic State that Muslim extremists claim to have is entirely different from that in the past.

  • Hadith permits pagans to live with Muslims and yet Islamic State wipes out Yazidis to establish Islamic State. The following is the extract: Narrated Ibn 'Abbas: The pagans were of two kinds as regards their relationship to the Prophet and the Believers. Some of them were those with whom the Prophet was at war and used to fight against, and they used to fight him; the others were those with whom the Prophet (ﷺ) made a treaty, and neither did the Prophet (ﷺ) fight them, nor did they fight him. If a lady from the first group of pagans emigrated towards the Muslims, her hand would not be asked in marriage unless she got the menses and then became clean. When she became clean, it would be lawful for her to get married, and if her husband emigrated too before she got married, then she would be returned to him. If any slave or female slave emigrated from them to the Muslims, then they would be considered free persons (not slaves) and they would have the same rights as given to other emigrants. The narrator then mentioned about the pagans involved with the Muslims in a treaty, the same as occurs in Mujahid's narration. If a male slave or a female slave emigrated from such pagans as had made a treaty with the Muslims, they would not be returned, but their prices would be paid (to the pagans). حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُوسَى، أَخْبَرَنَا هِشَامٌ، عَنِ ابْنِ جُرَيْجٍ، وَقَالَ، عَطَاءٌ عَنِ ابْنِ عَبَّاسٍ، كَانَ الْمُشْرِكُونَ عَلَى مَنْزِلَتَيْنِ مِنَ النَّبِيِّ صلى الله عليه وسلم وَالْمُؤْمِنِينَ، كَانُوا مُشْرِكِي أَهْلِ حَرْبٍ يُقَاتِلُهُمْ وَيُقَاتِلُونَهُ، وَمُشْرِكِي أَهْلِ عَهْدٍ لاَ يُقَاتِلُهُمْ وَلاَ يُقَاتِلُونَهُ، وَكَانَ إِذَا هَاجَرَتِ امْرَأَةٌ مِنْ أَهْلِ الْحَرْبِ لَمْ تُخْطَبْ حَتَّى تَحِيضَ وَتَطْهُرَ، فَإِذَا طَهُرَتْ حَلَّ لَهَا النِّكَاحُ، فَإِنْ هَاجَرَ زَوْجُهَا قَبْلَ أَنْ تَنْكِحَ رُدَّتْ إِلَيْهِ، وَإِنْ هَاجَرَ عَبْدٌ مِنْهُمْ أَوْ أَمَةٌ فَهُمَا حُرَّانِ وَلَهُمَا مَا لِلْمُهَاجِرِينَ‏.‏ ثُمَّ ذَكَرَ مِنْ أَهْلِ الْعَهْدِ مِثْلَ حَدِيثِ مُجَاهِدٍ وَإِنْ هَاجَرَ عَبْدٌ أَوْ أَمَةٌ لِلْمُشْرِكِينَ أَهْلِ الْعَهْدِ لَمْ يُرَدُّوا، وَرُدَّتْ أَثْمَانُهُمْ‏.‏ The above is the extract from Sahih al-Bukhari 5286, In-book reference book 68, hadith 35, USC-MSA web(English) reference: vol 7, book 63, hadith 210. The phrase, pagans were of two kinds as regards their relationship to the Prophet and the Believers..the others were those with whom the Prophet made a treaty..and neither did Prophet fight them, as mentioned above implies Prophet Muhammad allowed pagans to live with them and he did not fight with them. Yet Islamic State people disallow pagans to live with them to wipe them out. The contradiction above shows the so-called Islamic State currently people pursue is entirely different from the time when Prophet Muhammad was around, since the Prophet allow pagans to live with them and yet contemporary Islamic State disallows and intend to wipe them out to establish Islamic State.

  • Islamic State acts contrarily against the book of Hadith.  
    First, Hadith forbids killing of slaves.  The following is the extract:
    It was narrated from Samurah that the Messenger of Allah said:
    "Whoever kills his slave, we will kill him: whoever mutilates (his slave). We will mutilate him, and whoever castrates (his slave), we will castrate him."
    أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، - هُوَ الْمَرْوَزِيُّ - قَالَ حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ، قَالَ حَدَّثَنَا هِشَامٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَهُ جَدَعْنَاهُ وَمَنْ أَخْصَاهُ أَخْصَيْنَاهُ ‏"‏ ‏.‏
    The extract above is from Sunan an-Nasa'i 4736, book 45, hadith 31, vol 5, book 45, hadith 7440.
    The phrase, Whoever kill his slave..we will kill him, as mentioned here forbids Muslims to kill slave.  Yet people in Islamic State persecutes their slaves.
    Hadith forbids to earn a living by calling slaves to work as prostitutes.  The following is the extract:

    Narrated Abu Huraira:

    The Prophet (ﷺ) prohibited the earnings of slave girls (through prostitution).

    حَدَّثَنَا مُسْلِمُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا شُعْبَةُ، عَنْ مُحَمَّدِ بْنِ جُحَادَةَ، عَنْ أَبِي حَازِمٍ، عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ نَهَى النَّبِيُّ صلى الله عليه وسلم عَنْ كَسْبِ الإِمَاءِ‏.‏
    The above is the extract from Sahih al-Bukhari 2283, book 37, hadith 23, vol 3, book 36, hadith 483.
    Hadith forbids selling slaves and giving them as present and Islamic State people distribute them as gifts or even sell them:

    Narrated Ibn `Umar:

    The Prophet (ﷺ) forbade the selling of the Wala' (of slaves) or giving it as a present.

    حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سُفْيَانُ، عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ قَالَ نَهَى النَّبِيُّ صلى الله عليه وسلم عَنْ بَيْعِ الْوَلاَءِ وَعَنْ هِبَتِهِ‏.‏
    The above extract is from Sahih Bukhari 6756, book 85, hadith 33, vol 8, book 80, hadith 748.
    Hadith forbids Muslims to trade slaves and yet Islamic State does it.  The following is the extract:
    Narrated Abu Hurairah:
    That the Messenger of Allah (ﷺ) forbade earnings of slave-girls.
    حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُعَاذٍ، حَدَّثَنَا أَبِي، حَدَّثَنَا شُعْبَةُ، عَنْ مُحَمَّدِ بْنِ جُحَادَةَ، قَالَ سَمِعْتُ أَبَا حَازِمٍ، سَمِعَ أَبَا هُرَيْرَةَ، قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ كَسْبِ الإِمَاءِ ‏.‏
    The extract above is from Sunan Abi Dawud 3425, book 24, hadith 10, book 23, hdith 3418.
    The extract below supports Hadith forbids Muslims to mutilate slaves.  Do you think it permits them to injure slaves and have illegal sex interaction with them?
    It was narrated from Samurah that the Prophet said:
    "Whoever kills his slave, we will kill him, and whoever mutilates his slave, we will mutilate him."
    أَخْبَرَنَا نَصْرُ بْنُ عَلِيٍّ، قَالَ حَدَّثَنَا خَالِدٌ، قَالَ حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَ عَبْدَهُ جَدَعْنَاهُ ‏"‏ ‏.‏
    The above is the extract from Sunan an-Nasa'i 4737, book 45, hadith 32, vol 5, book 45, hadith 4741.
    Hadith forbids Muslims to beat their slaves.  The following is the extract:
    'Ammar ibn Yasir said, "None of you beats his slave unjustly without the slave receiving retaliation from him on the Day of Rising."
    حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، وَقَبِيصَةُ، قَالاَ‏:‏ حَدَّثَنَا سُفْيَانُ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ مَيْمُونِ بْنِ أَبِي شَبِيبٍ، عَنْ عَمَّارِ بْنِ يَاسِرٍ قَالَ‏:‏ لاَ يَضْرِبُ أَحَدٌ عَبْدًا لَهُ وَهُوَ ظَالِمٌ لَهُ إِلاَّ أُقِيدَ مِنْهُ يَوْمَ الْقِيَامَةِ‏.‏
    The above extract is from Al-Adab Al-Mufrad 181, book 9, hadith 26, book 9, hadith 181.
    Hadith forbids illegal sexual relationship with slaves and yet Islamic State people capture Yazidis and cause their people to have sex violence with them one after another.  The following is the extract:
    Malik related to me from Nafi that a slave was in charge of the slaves in the khumus and he forced a slave-girl among those slaves against her will and had intercourse with her. Umar ibn al-Khattab had him flogged and banished him, and he did not flog the slave-girl because the slave had forced her.
    حَدَّثَنِي مَالِكٌ، عَنْ نَافِعٍ، أَنَّ عَبْدًا، كَانَ يَقُومُ عَلَى رَقِيقِ الْخُمُسِ وَأَنَّهُ اسْتَكْرَهَ جَارِيَةً مِنْ ذَلِكَ الرَّقِيقِ فَوَقَعَ بِهَا فَجَلَدَهُ عُمَرُ بْنُ الْخَطَّابِ وَنَفَاهُ وَلَمْ يَجْلِدِ الْوَلِيدَةَ لأَنَّهُ اسْتَكْرَهَهَا ‏.‏
    The above is the extract from USC-MSA web (English) reference: book 41, hadith 15; Arab reference: book 41, hadith 1517.
    The phrase, he forced a slave-girl among those slaves against her will and had intercourse with her..Umar ibn al-Khattab had him flogged and banished him, as mentioned here implies hadith forbids sex violence with slaves.
    Did hadith promote punishment for the victims?  No, it does not punish the slave-girls since the phrase, he did not flog the slave-girl, is mentioned.
    From the above, it is obvious that the so-called Islamic State people act contrarily against the words of hadith.  They capture Yazidis girls and persecute them.  They even have sexual violence with them and yet allow their men to enjoy and yet to go without punishment.  They have turned the words of Hadith upside down.  They say they establish Islamic State is to act according to the book of hadith and yet they actually go against the words of hadith.
