“We, the people of India, having solemnly resolved to constitute India into a ‘Sovereign Socialist Secular Democratic Republic’ and to secure to all its citizens: Justice, social, economic and political, liberty of thought, expression, belief, faith and worship, equality of status and of opportunity and to promote among them all, fraternity assuring the dignity of the individual and the ‘unity and integrity of the Nation, In our Constituent Assembly this twenty sixth day of November, 1949, do hereby adopt, enact and give to ourselves this Constitution.” (The Preamble to the Constitution of India)

This brief introductory statement is the preamble to the Constitution of India which is also referred to as the preface and reflects the fundamental principles of Indian Constitution to ensure (1) Right to Equality, most significantly a) equal protection of law, b) social equality, c) equal opportunity, d) abolition of untouchability, and e) abolition of title, (2) Right to Freedom, such as freedom of speech and expression, freedom to assemble peacefully without arms, freedom to form associations, freedom to move freely, freedom to reside and settle in any part of the country, freedom to practice any profession or to carry on any business, right to life and personal liberty, (3) Right against Exploitation, (4) Right to education and culture and (5) Right to Constitutional Remedies, etc.

The phrase “we the people of India…” is inclusive of all citizens—Hindus, Muslims, Christians, Jews and Sikhs, to name more significantly. There is no place for any sort of discrimination based on religion, caste, culture and race. The solemnized resolution is on the part of all Indians to secure justice, liberty, equality and fraternity for all people at all levels. The very basic phrase binds the Muslims and non-Muslims into a culture of pluralism and inclusiveness, for which India is known as one of the largest democracies of the world.

More interestingly, the legislature, the executive and the judiciary – all have to pass by the solemnized resolution in order to perform their designated duties respectively, uphold the Constitution of India and equally secure the rights and wishes of the people, with all their sincerity and purity of hearts, without any discrimination.

This is in theory what we read and apply to primarily interpret all other principles, clauses and articles of the Constitution. The lawyers, advocates and judges, all are believed to be expert anchors of the Constitution. However, with the rise of mis-interpretative skills of the devils taken into force by the modern ‘jihadists’ from among ISIS and Taliban, it is highly recommendable for us to be active in not letting our Indian Constitution be misused by the hands reportedly coloured with blood of innocent civilians, women, widows, children, elderly people and the downtrodden.

All this I need to present here is because it is high time we need to bravely and fearlessly utilize lens of the fundamental right to freedom of speech, liberty of expression, and equality of status to read the hottest subject of each and every Indian now as NRC, CAA and NPR. Since the CAA (2019) bill has been passed, the overcrowded protests against NRC, CAA and NPR are taking place day and night all around India. The people are raising their voices not to accept at any cost the three plans that are “a clearly combined threat to their citizenship, life, dignity and security”. In this wake-up call, the students, teachers, lawyers, judges, more prominently women including young and old, all have come on the roads regardless of religion, caste and culture to express their “unity and integrity of the Nation” in the same spirit as mentioned in the Preamble of the Indian Constitution.

The sincere intellectuals, thinkers and journalists who had a dream of seeing the people of India in a clear picture of diversity and video-screens of Ganga-Jamuni culture are now enjoying their ever-seen dream in practice. Sooner or later, the other silent spectators are expected to peacefully come on the roads to support the slogans of ‘Aazaadi’ from hatred, divide-and-rule politics and discriminatory bills. Perhaps they still have a waiting expectation in the Judiciary body, after they have lost trust in the present faces of the legislative body.

Another point to think the other way round is that the widespread protests “will not be a turning point for the Modi-Amit Shah government until “ordinary Hindus” join it in large numbers”. In one of his opinions, Mr Asim Ali says, “The base of the CAA-NRC-NPR protests remains confined to the groups that were already opposed to the BJP government: the largest number has been provided by Muslims, along with liberal middle-class professionals, Leftists, and dissenting students. The surprising participation is of a number of ‘apolitical’ (or politically passive) young people, who might have largely been silent over the past few years. Now, they are speaking out on social media, attending protests, and joining the camp of active, politically engaged dissenters. What will consequently come out depends on how the anti-CAA-NRC-NPR protests now expand. However, the protestors are likely to have ‘solemnly resolved’ that they will constitute India into the same Ganga-Jamuni culture, pluralism, ‘unity and integrity of the Nation’. They can be seen with fearless attitude and the more the police Lathi-charge the protestors, the bigger support comes to embrace them. It is unlikely that these people of India will stop their protests unless the BJP government shifts its current plans and restores equality, pluralism, and trust by retracting from its stand, as the pulse of the nation is heavily united in the spirit of diversity, be it in silence or demonstration.

Interestingly out of the two different displays of “Islamic conduct” what was being supposed has been proved wrong. The Jihadist ideology was trying to brainwash Muslims to fight ‘Jihad’ for their religion and eliminate the “Kufr-system” of democracy. But the protesting Muslims have rejected the jihadist ideology, exclusion and supremacism. Instead they have proven with their peaceful protests that they will die remaining, though as a minority part of the Indian democracy, but will never walk on the path of violence, nor on the path that leads to ‘detention centres’.

These Muslims were silent on religious issues, such as criminalisation of Islamic Personal Laws and Babri Masjid demolition. It was thought Muslims are afraid. But this has proven wrong. Their silence was merely meant to help maintain peace. They have come out now fearlessly thinking that their beloved constitution is at risk. They think it is high time they proclaim their constitutional and Islamic value of unity in diversity. The protesting Muslims are now seen to be stopping youngsters from chanting Allah O Akbar and La Ilaha Illallah etc, in these demonstrations. They are insisting on keeping protests secular rather than making it religious.

Clearly Muslims believe that the Indian Constitution is of utmost spiritual importance and guarantees safety, security, citizenship and dignity to all who live in the country. They also know that after independence in 1947, they had promised to respect and abide by the values of the Indian Constitution at all cost. So,they should not break their promise, as Islam teaches them the opposite: “And fulfil (every) promise. Verily! the promise, will be questioned about” [al-Isra’ 17:34]. All they need to strengthen their constitutional voice in their wave of protests is be confined to peaceful nature,surely expecting that their demand will definitely be accepted.

    In regard to second Question rather than answering you had allegation on me, and try to justify the action of your prophet towards surrender and vanarable people, so leave to  Hindu redears that if some action is justified on name of religion that history can repeat with us.
    As Gulam Mohiyuddin said it depends on me to trust so leave on Hindus to how much we can trust if someone rather than answering says you hate Islam, so he openly saying that if you question action of our Paigmebr you will become hater of Islam which can be prosecuted later on if they come in power.
    Ask this hard questions to Muslims now, their answers will be helpful to Hindus what they can do to us.

  • Aayina sb, Trusting or not trusting is your personal matter; I would not dare to speak anything in this regard. You may think that as a Muslim I belong to minority and if I ask you trust us, you make take it as the voice of an opportunist. Anyway, I would like to say something about your first question in this comment.
    Having fought against British as outsiders and oppressors under one flag, Hindus and Muslims got divided into two different boundaries known as India and Pakistan. This was not the fault of majority of Hindus and Muslims. As for the religions of Muslims and Hindus, they had nothing to do with this issue. It is usually seen that common citizens are always pieced into bhashan of different classes of political netas. So there were some political netas from both Hindus and Muslims who implemented the hidden agenda of Angrez and divided Indians, leaving the common Indians in lurch as all of them belonged to the undivided India. You may disagree with me but what I speculate with the historical materials that this was not the batwara of Hindus and Muslims but a batwara of Muslims themselves. Approximately half of the Muslim population preferred India to Pakistan, trusting humane nature of majority of Hindus and rejecting the effect of politics of those Muslim leaders who fled to Pakistan.
    Now the same humane nature of majority of Hindus is still appearing and this makes Muslims retain their trust on them. However, there are some voices which have been brainwashed so much that they will always try to break this mutual trust of peace and security by pretending to make the argument that majority of Hindus do not trust Muslims and hence Muslims need to prove something in this regard. But the fact is that mainstream majority of Hindus still trust Muslims and they do not need to ask Muslims to show documents of trust. Those who do not trust will never trust, not even when they are given the documents of trust.
    Those who did crimes of dividing India actually need to be questioned but they are not alive.

    A serious Questions from Hindu mindset.let say we want to trust Muslims but let see the History and answer the Question so we can trust Muslims.
    1) Before 1947 we all fought against British as outsider and oppressor under one flag, so keep in mind Majority Muslims and Majority Hindus were upholding tricolour, than suddenly Islam came into Danger and we had Pakistan, now as Hindu my thoughts are Muslims used us tissue paper, because alone Muslims were weak to fight British once the means were achieved get rid of Hindus that is what I will think as Hindu.
    2) Now Muslim history openly says how your so called peace loving and merciful messenger killed whole men of surrendered Banu Qureza and sold the women's and kids, your Paigmebr did not gave Ammensty to Banu Qureza even we Hindu Kafir Goverment of India also gave Amensity to Muslims of Pak Zamin Pakistan but still this Pakistan constantly says this is Darul-Harb and Gazwe-Hind, again back to history Your Paigmebr gave Amenesty to his own Quresh race or Arab race which converted to Islam but not to Jews, so now Question is past history action by your Paigmebr and recent act of Muslims from Sub-continent and actions of even Indian Muslims to ask evething thing separate from Other citizen of the county how can we trust and back mind of Muslim is to kill and finish whole Hindu like Banu Qureza after all it is sunnat to do what your paigmaber did.
    Even  holding of tricolour flag will also keep doubt in Hindus as mentioned earlier before 1947 we all use to hold the flag that did not garantee United India  as actions of Muslims have never been peaceful towards Hindu, you Muslims still through stones on kevads, creat problem in Ganesh Chaturthi and Durgastmi in India

  • If Indian Constitution is respected all around the globe, it is because of Hindus who designed it. Actually they promoted ethos of Hinduism in a different form to earn respect even from the class of Muslims whose faith is different from theirs, as can be seen in today’s forms of protestors who are holding the flags of Constitution.

    If Indian Constituion is respected, it is respected because of the majorities who designed this Constituion.

    The credit definitely goes to the religion of Indian majorities which spiritually helped them frame such a beautiful constitution.

    In books of Swami Vivekananda, Mohandas Karam Chand Gandhi, and Ambedkar etc, Hinduism shows a different form of spirituality and humanity, which is acceptable to all citizens of India. This is really a great work they did in the past. But some people our fellows fail to understand their work to promote true ethos of Hinduism. They were the real experts of Hinduism and therefore all it happened.

  • I have something to say in reply to your question and would like you and other commentators to correct me if I am wrong.

    Hindu pundits, if persecuted in Kashmir, are really a matter of concern. We should reject such habit of persecution from any class, be it from Muslims or non-Muslims.

    Who persecuted Hindu pundits in Kashmir? Those were the criminals who persecuted Hindu pundits and should have been brought to the court of punishment. Hindu pundits should come out to mention the names of those criminals who persecuted them and it is our responsibility to punish those criminals and not to take to revenge from Muslims.

    Now the questions strike us, can we repeat the same criminal attitude by persecuting any humans including Muslims? No we are not going to take unjust revenge and not to give the world a chance to laugh at this attitude of ours. We are not the likes of those who persecuted Hindu pundits by persecuting non-Hindus. We are not the likes of those who supported the persecution of those pundits. But we are those who condemn such persecution and we are those who do not like to repeat the same persecution by persecuting the Muslim fellows living non-Kashmir parts of India. We are not like the ones who should persecute the Kashmiri Muslims because a handful of their religious fellows persecuted Hindu pundits. We are in a much better position of human behavior that we know the rules of justice by ensuring place of dignity and safety for the persecuted Hindu pundits and not by taking revenge from other Muslims.

  • The protesters say “it is not the issue of Hindu and Muslims, but it is about their rights”. The government is defending its arguments such as “this Act and the chronology of NRC will not deprive Muslims of Indian citizenship”, with no change even after so many protests across the country.

    The Constitution-makers are not alive today to teach today’s people of India that when people come on the road to demand their assurance of safety, security and citizenship, they must be heard and not be left simply as the “worthless citizens crying for their rights of speech, dissent, etc. Whatever the arguments are aired on media by the leaders and politicians to convince the protestors and their silent supporters, who have understood or misunderstood the CAA, will take time to convince these people. On the contrary, if the demands of these people are accepted immediately, the government will definitely win the hearts of these people, and the political party will record a new history in its move.

    Muslims need a political party which can assure them no-discrimination, no-distinction, no-division on state or political level. No matter if the party is Congress, BJP or AAM. LEAVE THE PAST AND ESTABLISH A NEW RELATIONSHIP BASED ON NO-DISCRIMINATION ON STATE LEVEL. OUR RELIGIOUS DIFFERENCES ARE CONFINED TO OUR DIFFERENT PLACES OF WORSHIP, YOURS TO THE DOOR OF TEMPLE, AND MINE TO THE DOOR OF MOSQUES. The Muslims are happy with their personal, religious and national rights. They do not need any Baghdadi’s ‘Islamic state’. Why is important for them is the ‘Constitution of India’. Taking their big hearts, they are waiting for listening to the convincing words that “Mitro, Bhaayio, we are going to fulfill your demands and say “no-to-caa”. O that it had happened. This would have formed a new sort of relationship in India between two communities, and the party would have governed longer and longer.

    Not even Hindu brethren are happy with hearing so much about protests. But packed with such news, they have lost their contentment and most of them are living in the state of unease. So it is high time for the protestors and the governing party that they come forward to form their unity on any set of trust and confidence and make India a prosperous country.

  • It is good to see at least Muslims and Hindus have come forward to speak high volume of their unity and integrity. I have written an article on this subject, purely theological, to deal with the force-conversion. The idea of forced-conversion is nothing but an idea of foolishness. There is nothing like forced-conversion in Islam. Islam categorically rejects this concept when it says, "There is no compulsion in the Religion". Its message is very clear and no one needs to force anyone to accept it. Actaully you are not the mastermind of all such games which are heavily played by the jihadists from Syria to Iraq and around the world. There were some so-called Muslims who were brainwashed and it looks like the many of fellows like you have been brainwashed by them to support their arguments. Anyway I am here to deradicalize anyone who needs to be so.

  • Mr Namit Singh, there are several war-related verses and ahadith but they can't be applied to today's context. There were some occasions when fighting was waged against religious persecutors. The country in which all such wars took place was not like today’s India.

    Hindus and Muslims both promised to live peacefully in India after partition of India. They mutually agreed to accept their document what is known as the Constittution of India. It was something like taking an oath. In other words, we vowed to live in a country which unlike many radical countries gives us more dignity and much better security. India is a country, better known as a democratic country, and its constitution creates a sense of honour in each and every citizen, regardless of culture, religion, caste and colour. We are differenrt in our religions but united on state level. Any foreign or jihadist threat to our India is a threat to our existence and we can unanimously fight for its safety at the cost of our sacrifice. However this is not happening. Muslims are silent except for some of them who, when being asked, issue a short anti-terror fatwa. On the other hand, some Hindus are busy spreading proganda that “if Islam exists in India it will be a threat to them”. In the Quran, Ahadith, and classical books, there are some passages which are purely war-related and not to the state of peace. When there was the state of fighting, they fought and in the case of peace, they remained peaceful. All wars were fought in the name of fighting against religious persecution.

    Living in India, Muslims do not go to take such things seriously as the very constitution gurantees their safety. The very constitution has been successful in saving Indians from the clutches of recruitment process which damaged Syria, Iraq, Pakistan, Afghanistan etc. The countries which were once prosperous are now scences of destruction. The jihadists and their hidden supporters who did marketing of weapons were the sole responsible. Marketing was done to spread the venom of jihadism and suicide bombing all around those countries and finally it destructed them.

    Some Indians were shocked to see such destruction and consequently they had a question in their minds that why Muslims in India are not Jihadists. Many of them asked me this question. I simply replied that it is all because of the beautiful Constittuon of India and the peaceful environment that Hindus and Muslims have made in this beloved country.

    But we have many problems now striking our India. APJ Abdul Kalam has passed away. He will not come back to give us solid base of relationship. So I think we should establish our integrity and unity very firmly that no one can dare to break our unity. We are a family in which if a brother is not happy then other obvisouly can’t be happy.

  • Ghulam Gaus, see the Kerala governor quoting from the authoritative book which is taught by Deoband to their children that defines jehad as inviting non Muslims to their fold of belief, and fight them if they refuse accept the invitation. This is a liberal interpretation of the Islamic scripture?
