Supreme Court of India Agrees To Examine Validity of Practice of Talaq-e-Hasan

NEW DELHI: The
Supreme Court on Thursday agreed to take up Muslim women's petitions
challenging the validity of talaq-e-hasan under the Muslim personal law, which
allows a man to unilaterally divorce his wife by pronouncing talaq, either
orally or in writing, three times with a gap of one month between two
consecutive pronouncements.
When a few
petitions led by one by Benazeer Heena came up before a bench of CJI D Y
Chandrachud and Justices P S Narasimha and J B Pardiwala, it said, "These
appear to be squarely challenging the constitutionality of the mode of divorce.
We need to set them up for detailed hearing."

Central
government counsel Kanu Agrawal said the SC had earlier dismissed Ashwini
Upadhyay's petition seeking uniform marriage, divorce and alimony law for women
irrespective of their faith on the ground that the subject fell in the
legislative domain.
"As
directed by the court, I have scrutinised the pending petitions (of Muslim
women) challenging talaq-e-hasan and found that all of them question the
validity of extra-judicial talaq. All the petitioners have a generic prayer
questioning the constitutionality of this mode of divorce in Muslim personal
law," he said.
It requested
Agrawal to prepare a chart giving a synopsis of each petition and the nature of
challenge to the divorce law "to have a bird's eye view" of the long
list of petitions. It posted the bunch of petitions for hearing next week.

In the Shayara
Bano judgment on August 22, 2017, a five-judge constitution bench, by a three
to two majority, had struck down talaq-e-bidat, the instant divorce given by a
Muslim man through pronouncement of triple talaq in one sitting, as
unconstitutional.
Heena and other
women have challenged the validity of talaq-e-hasan and its unilateral use by
men to annul their marriages in collusion with qazis to leave women in the
lurch. Another woman said in her petition that her husband divorced her by
pronouncing talaq three times over WhatsApp messages.

A PARTNER at a
law firm has scooped a double at a national awards ceremony.
Asma Iqbal,
Partner in Litigation, Corporate Recovery and Insolvency at Chadwick Lawrence,
which has offices in Bradford and Guiseley, received prizes at the British
Muslim Awards 2023.
She was
recognised as the Business Leader of the Year 2023 and was also awarded Highly
Commended for Achievements in Law.
The awards
ceremony, held at the Muslim Heritage Centre Marquee in Manchester, celebrated
the exceptional achievements and contributions of British Muslims across
various fields, and is one of the most respected events in the Muslim
community.
Asma said: “I
am honoured to have been nominated as a finalist in two categories at the
British Muslim Awards and it’s an absolute delight to have received the
Business Leader of the Year Award 2023.
“This is truly
a career highlight for me and I hope it inspires the next generation of Muslim
women in law”.

Hijab-Wearing Chef, Sherifah Yunus Olokodana, Seeks to Break Stereotypes about
Muslim Women

LAGOS (Reuters)
– Nigerian Sherifah Yunus Olokodana looks like any Muslim woman with a veil
that only exposes her eyes, but the entrepreneur who has carved a niche as a
chef in Lagos is seeking to break stereotypes about hijab-wearing women in the
country.
Nigeria is
almost evenly divided between the largely Christian south and mainly Muslim
north, where cultural norms often discourage women to get into business.
Olokodana, a
Yoruba Muslim from the southwest, has been a pastry chef for nearly two decades
and sells food spices, but she said she still faced prejudice.
“Being a woman
who dresses this way, I have to do 10 times the work of the average woman,” she
said while preparing for an Instagram cooking show in her studio.
“Women in hijab
continue to get negative vibes from people. People who dress the way I’m
dressed are looked down upon in Nigeria.”

First-ever
women’s polo tournament in Saudi Arabia to take place in November

RIYADH: The
first-ever women’s polo tournament in the Kingdom will take place in November
at Al-Ittihad Academy Stadiums at the Nofa Equestrian Club Resort, near Riyadh,
the Saudi Polo Federation has announced.A Saudi women’s polo team will compete
against Arab and international opposition for the first time at the event. The
federation and Al-Hawafir Sports Company, the tournament’s official partner,
are working with leading stables in Riyadh, Jeddah and Dammam to help the Saudi
players prepare for the tournament.
Fashion shows
featuring designers from the participating countries will take place on the
sidelines of the tournament, organizers said.
Omar Zaidan,
the president of the federation, said it is working to promote women’s sports
and raise awareness of polo in line with the federation’s own strategy and that
of the Saudi Olympic and Paralympic Committee.

Ex-Spy Chief of
Malaysia HasanahAb Hamid Dies

PETALING JAYA:
Former spy chief HasanahAb Hamid has died. She was 66.
Her son-in-law,
KhairilQaiyum Aisha, confirmed with FMT that Hasanah died at noon after
suffering from liver cancer.
“She had been
diagnosed with liver cancer in September last year,” he said.
Hasanah will be
laid to rest at the Kajang Muslim cemetery.
One month prior
to the diagnosis, the High Court in Kuala Lumpur had acquitted her over a
criminal breach of trust (CBT) charge involving RM50.4 million of the
government’s money.

Royal Expert Tina Brown: Prince Harry’s Jihad against the Tabloids Is Justified

Journalist and
royal expert Tina Brown has said she admires Prince Harry’s combative stance
against the media.
Speaking ahead
of the Coronation of King Charles, Press Gazette asked Brown – author of The
Palace Papers – what she made of Prince Harry’s ongoing lawsuits against the
publishers of The Sun, Mirror and Mail titles over allegations of phone-hacking
and illegal information gathering dating back around 20 years.
She said: “I
actually admire Harry’s jihad on this. Flashman Harry, Harry the hand grenade.
“One of the
problems with hacking the rich and the famous is that they’re rich and famous,
right? I mean, ultimately Harry said ‘you know what, I don’t have to settle’.”
Prince Harry is
suing News Group Newspapers over allegations of illegal information gathering
at The Sun and News of the World. In a separate case he is suing Mirror Group
Newspapers over similar allegations, while in a third he claims the Mail titles
were involved in criminal information gathering which is said to have included
the use of audio surveillance devices.
Brown wrote a
chapter in her book about surveillance of the Royal Family, entitled
“Snoopers”.
Brown told
Press Gazette: “I was shocked as I reported that out actually, because I really
hadn’t quite understood the torment that the young adolescent Harry was put
through with the hacking.
“As well as
being tormented by the media scrutiny, he was in a constant state of like, ‘how
do they know? Who’s betraying me? Which of my friends can I trust?’
“It created
such a level of insecurity for him about who he could trust, a real paranoia
because the papers would seem to know about things before they’d hardly even
been scheduled…
“His
girlfriends’ travel plans were hacked. Their medical records were hacked. So
they ruined so much of his life.
“And on top of
that, of course, he looks back on what his mother went through and, you know,
of course he sees the press as having killed his mother.
“That is a very
complicated issue that, you know, he will not really confront in that Diana
also did have issues where she actually did sort of promote herself a lot with
the press.
“What is true
is that Diana, too, was absolutely haunted with the paranoia about who was
leaking on her all the time.
“She dispensed
with her police protection, which could have saved her life in Paris, mostly
because she felt that they were leaking on her. Well, they weren’t.
“When you think
about that, you do understand why Harry thinks ‘you know what, I have the funds
now, I don’t care, I’ve got nothing to lose. I’m not one of the royal family
really anymore.
“I don’t have
to care about the ongoing collusion between the press and the Royal Family so
I’m just gonna go for it.'”
Tina Brown was
speaking to the Press Gazette Future of Media Explained podcast about the
legacy of her late husband Sir Harold Evans and the investigative journalism
conference bearing his name which is taking place in London on 10 May.
